      "SOMERVILLE
      The funeral service of Charles W. Toothaker will be held at 2:30 o'clock tomorrow afternoon at his residence, 342 Broadway, Winter Hill. Rev. Stephen C. Lang, pastor of the first Congregational Church Franklin st., will officiate and burial will be in Woodlawn Cemetery. Mr. Toothaker, who was president of the Seven Oaks Dairy Company, died suddenly of a heart attack Thursday night. He was born in Brunswick, Maine, 67 years ago; had lived in Somerville 55 years, and for 48 years had been in the milk business. His brother, Herman A., is vice president and organizer of the Seven Oaks Dairy Company. The firm name was formerly Toothaker Brothers. Charles was a life member of King Solomon Lodge, A.F. and A.M."

      Woman Gives Answers in $50,000 suit
      In answer to interrogatories filed by the defense in Middlesex Superior Court, in a $50,000 action recently brought by Miss Grace S. Oliver of Arlington, against the estate of the late Charles W. Toothaker, Somerville milk dealer, Miss Oliver sets forth that a most intimate friendship existed between her and the late Mr. Toothaker.
      Miss Oliver, who alleges in her suit that Toothaker promised to support her comfortably as long as she lived in return for the 'time, society, attention and assistance' she gave him during his life time, states in her answers that she is 68 years old and single.
      She states that she became acquainted with Toothaker 41 years ago and was on intimate terms with him until his death.
      Before 1929, she answers, he made her occasional gifts of money, and from the autumn of 1929 until his death he made her regular monthly payments, together with other irregular payments, amounting to $1500 a year.
      She further states that at his request she bought much of his personal apparel, and that he expected her sole and undivided attention and came to see her regularly at least twice a week. She would read to him and help him in his personal financial matters, she states, and this relationship existed for over 25 years.
      Miss Oliver sets forth that the alleged promise of Toothaker was made orally, but in the presence of another, and that he first made the promise when his mother died. He told her she sets forth, that he would provide for her comfortably and would see that she would not want for anything as long as she lived.
      Herman A. Toothaker, brother of the deceased and administrator of the estate, is named as defendant in the suit and is contesting. The late Mr. Toothaker left an estate estimated at $80,000."
